Power of Attorney
A lasting power of attorney (LPA) is a legal paper that lets you choose someone (called your “attorney”) to help you make decisions or make decisions for you. This is useful if you have an accident or get sick and can’t decide things for yourself.
To make an LPA, you must be at least 18 years old and able to make your own choices. You don’t need to live in the UK or be British.
There are two kinds of LPAs:
- Health and care decisions
- Money and property matters
You can pick one or both.
Here’s how to make an LPA:
Choose your attorney (you can pick more than one).
Fill out the forms to appoint them as your attorney.
Register your LPA with the Office of the Public Guardian. This can take up to 20 weeks and costs £82 unless you qualify for a discount or don’t have to pay.
You can cancel your LPA if you don’t need it anymore or want to make a new one.
For health and care decisions, your attorney can decide things like your daily routine, medical care, moving into a care home, or life-saving treatment. This LPA is only used when you can’t make decisions for yourself.
For money and property matters, your attorney can handle things like managing your bank account, paying bills, getting benefits or pension, or selling your home. This LPA can be used as soon as it’s registered, with your permission.
